White Rock Winter Maintenance — Bylaws, Liability & Property Responsibility

White Rock requires owners to clear snow and ice from sidewalks bordering their property by 10:00 a.m. following a snowfall. That municipal obligation addresses the public sidewalk; private walkways, stairs, driveways, parkades, and other property surfaces remain part of the broader duty to manage premises reasonably safely under BC law.

White Rock’s Street and Traffic Bylaw states that the owner of every parcel must remove snow or ice from any sidewalk bordering the property no later than 10:00 a.m.

The Duty Falls on the Property

The bylaw specifically places the sidewalk-clearing obligation on the owner of the parcel. A property’s winter plan therefore needs to account for bordering public sidewalks as well as surfaces within the site.

BC Reasonable-Care Duty

BC’s Occupiers Liability Act requires an occupier to take reasonable care in the circumstances so people using the premises are reasonably safe. The duty applies to the condition of the premises, activities there, and third-party conduct.

Strata Common Property

BC’s Standard Bylaw 8 places repair and maintenance responsibility for common property and common assets on the strata corporation, subject to limited-common-property provisions and the strata’s registered bylaws.

What the City Does & Doesn’t Cover

Priority 1 — major roads, emergency access routes and bus routes

Priority 2 — secondary through-roads in residential areas

and then non-priority routes after the higher priorities are under control. City Parks staff clear civic-facility sidewalks/parking and then other municipal walkways such as the waterfront promenade.

Public Priorities vs. Property Access

The Bylaw Ticket Is Not the Main Liability Risk

Municipal compliance and civil liability are separate. A slip-and-fall incident can create a personal-injury claim even where the municipal ticket amount is modest. BC law asks whether reasonable care was taken in all the circumstances, and when work is outsourced, section 5 makes reasonable contractor selection and supervision legally relevant.
